Project Description:

Project Description:

The applicant proposes a discharge of 80,000 gallons per day of treated sanitary wastewater to Lake Ontario, a Class A waterbody, from a new aerobic biowheel treatment plant located at the applicant's facility located at the proposed Cottages at Troutburg site at 19 Monroe-Orleans County Line Road, Town of Kendall. The applicant plans to construct the new treatment facility to serve the proposed three-season 400 cottage resort community located at the same location.

The Department has made a tentative determination to issue a State Pollutant Discharge Elimination System Permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards of permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or the endorsement of the activity for which a permit is sought or for the overall proposed project.

Additionally, the applicant is proposing the construction of an outfall below the mean high water level of Lake Ontario consisting of an outfall pipe extending out approximately 500 feet beyond the mean high water line to an elevation of 240 feet (IGLD'85). A 2 foot x 2 foot x 2 foot concrete diffuser will be installed at the end of the pipe. Also, while the applicant has proposed the installation of approximately 500 linear feet of stone revetment above the mean high water level of Lake Ontario, which is outside the Department's Article 15 regulatory jurisdiction, the Department will likely authorize limited operation of equipment below the mean high water level, if required.

The Department has also determined the applicant's 401 Water Quality Certification application is complete. As part of the overall resort community development the applicant is proposing to fill approximately 0.23 acres of federally jurisdictional wetland. To mitigate the proposed impacts the applicant is proposing the creation of 0.37 acres of wet meadow shrub habitat. The U.S. Army Corps of Engineers has authorized the proposed wetland impacts under provisional Nationwide Permit No. 29 (2011-01576).

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
