Project Description:

The Department has received and made a tentative determination to approve an application for an individual Section 401 Water Quality Certification for the construction of a 73-unit apartment complex comprised of two three-story buildings and appurtenant structures located at 4505 Chestnut Ridge Road in the Town of Amherst. The proposed project will permanently impact 0.44 acres of federally regulated wetlands. To compensate for the loss of 0.44 acres of wetlands, the applicant proposes to purchase 1 full mitigation credit from the Raymond Road mitigation bank. Appropriate sediment and erosion controls will be used to maintain the water quality of the wetland. The Department is seeking public comment prior to making a final decision on permit issuance.

Project Description:

The applicant proposes to replace approximately 11,300 feet of natural gas pipeline in the Town of Elma. The pipeline replacement project starts at Pound Road approximately 1,200 feet south of its intersection with Bullis Road, runs in a south east direction, crosses Rice Road and terminates at Meadowbrook Drive. The right-of-way crosses several protected streams and State regulated Freshwater Wetland OP-1. Impacted wetlands will be restored to pre-construction contours and seeded with a wetland meadow mix.
