Project Description:

Applicant proposes to remove nine existing poles for electrical lines on property on the west side of Cookson Road and relocate six of the poles to the northern right-of-way of Cookson Road. Four of the poles are within mapped State Freshwater Wetland BS-17 (Class 2) and/or its 100-foot adjacent area. This relocation project will allow easier access to the poles and eliminate future impacts to the wetland that would occur during maintenance. Temporary impacts total approximately approximately 37,110 square feet to place timber mats for equipment access, clear vegetation, and remove and place the poles.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0024449), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). The facility has treated surface discharge to the Genesee River, a class C water. The Village of Avon Wastewater Treatment Plant has a design flow of 2.75 mgd. Treatment at the facility consists of manual grit settling (currently bypassed), one primary clarifier, one trickling filter and one final clarifier. Sludge is gravity thickened, anaerobically digested, dried on reed beds and drying beds, and then hauled to a landfill. DEC proposes to incorporate the following modifications to this permit: -Administrative changes have been made to the first, second and last pages of the permit. -The 5-day Biochemical Oxygen Demand and Total Suspended Solids have been revised. -Monitoring for the Daily Maximum of Flow and Phenol has been added. -A seasonal effluent limit for Total Ammonia (as NH3) during the months of May through Oct has been added. -Influent monitoring for Total Kjeldahl Nitrogen and Total Ammonia (as NH3) has been added and sampling frequency increased to weekly. -Turbidity monitoring has been added. -An effluent limit (Daily Maximum) for Total Unchlorinated Phenols has been added. -Quarterly Whole Effluent Toxicity (WET) testing has been added with action levels for acute toxicity and chronic toxicity. -A seasonal monthly average effluent limit for Total Phosphorus has been added, with the limit in effect from May through Oct. -An action level for Total Copper has been added. -The Mercury Minimization Program for Low Priority POTWs has been added. -Discharge Notification Requirements have been updated. -The Pretreatment Mini Schedule pages have been updated. -A Schedule of Compliance item requiring the permittee to evaluate the removal of Total Phosphorus from its effluent to the greatest extent practicable has been added. -A short term high intensity monitoring program for parameters have been added on the Schedule of Submittals page. -A schedule of submittals item has been added, including the dates of submittal of the Mini Pretreatment Program. -The Monitoring Locations page has been updated.

The applicant proposes the renovation, including a 438 square foot addition, to an existing house located within the regulated Coastal Erosion Hazard Area. The remaining portion of the existing home will be raised above 252 feet in elevation to meet the local flood plain requirements. As proposed, the addition will require a variance from the Coastal Erosion Hazard Area regulations (6 NYCRR Part 505) for a small section of the 3 feet wide addition which is located within the Natural Protective Feature Area.
