Statement of Basis IBM-Kingston/Tech City Properties, Inc.
The New York State Department of Environmental Conservation (NYS DEC) is reviewing its decision to close 12 Solid Waste Management Units (SWMUs) and 3 Areas of Concern (AOCs) at the International Business Machines Corporation (IBM) Kingston Facility, known as Tech City Properties, Inc., located at Neighborhood Road in the Town of Ulster, Ulster County, New York.
NYS DEC recommends either No Action or No Further Action for each of the SWMUs and AOCs proposed for closure. These recommendations are based on sampling, for each SWMU or AOC, that indicate that no contamination is present or contamination has been addressed through interim corrective measures. The closure of these areas will not affect the groundwater pump and treat system currently operating at the facility.
A Statement of Basis and fact sheet are available for public review at the NYS DEC headquarters office in Albany, New York and at the Town of Ulster Public Library.
Interested persons may submit written comments or request a public hearing on the Statement of Basis no later than March 29, 2013.

Westchester County - The City of Yonkers Planning Board, as lead agency, has determined that the proposed Hudson Park III will not have a significant adverse environmental impact. The action involves a proposal by the applicant, Collins Enterprises, LLC, which is before the Planning Board for a proposed new waterfront development. The proposed use includes a new 23 story residential tower with 222 units, and contain approximately 210,675 square feet. The applicant is also proposing to add 160 parking spaces to the existing parking garage and approximately 13,320 square feet of amenity space. The current riverfront esplanade will also be continued along the Westchester County property that fronts on the Hudson River.
This action will include an amendment of the current Waterfront Master Plan and Design Guidelines, a subdivision application, a special use permit application for the Planned Urban Redevelopment and a Site Plan Application.
The project is located on Alexander Street, Wells Avenue, Front Street and Dock Street in the City of Yonkers, New York.

Westchester County - The Town of New Castle Town Board, as lead agency, has determined that the proposed SG Chappaqua B, LLC may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves the New Castle Town Board consideration of a proposed Local Law that would amend the Town Development Plan concerning commercial development policies and would amend New Castle Town Code Chapter 60 to adopt new zoning text provisions to establish an Office Park Retail Overlay District but would not map the district but set procedural standards that would apply to the future mapping of an Office Park Retail Overlay District in a Research and Office Business District and set substantive standards that would apply to any development proposed with a mapped Office Park Retail Overlay District. While the Town Board has been considering the Proposed Local Law, they received an SEIS - Proposed Project Petition in the Application of SG Chappaqua B, LLC seeking (i) amendment and adoption of the Proposed Local Law and application of the Office Park Retail Overlay District zoning to a portion of the Applicant's Property consisting of approximately 23.9 acres (or 33% of the 71.9 acre B-RO-20 District); (ii) approval of a Preliminary Development Concept Plan for the Proposed Retail Zoned Portion; (iii) amendment of the Preliminary Development Concept Plan and of the conditions therein adopted April 11, 2011, on the zoning to Multi-Family Planned Development of a portion of the Property consisting of approximately 30.6 acres; and (iv) amendment of the Town Zoning Map to map the Proposed Retail Zoned Portion.
The project is located in the Town of New Castle, New York, consisting of 114 acres and several adjoining parcels consisting of approximately 6 acres, all located generally east of the Metro-North Harlem Division railroad line and the Saw Mill River Parkway, north of Roaring Brook Road, and west of Bedford Road (NYS State Route 117) and Cowdin Lane on property commonly known as the Reader's Digest property.

Notice of Acceptance of Draft EIS and Public Hearing
Rockland County - The New York State Office of Parks, Recreation and Historic Preservation (NYS OPRHP), as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Adoption and Implementation of a Master Plan for Rockland Lake, Hook Mountain, Nyack Beach and Haverstraw Beach State Parks. A public hearing on the Draft EIS will be held on March 27, 2013 at 7:00 p.m. at the Rockland Lake State Park Championship Golf Course Clubhouse, Championship Road, Congers, NY. Written comments on the Draft EIS will be accepted until April 10, 2013. The Draft Plan / Draft EIS is available for review at the offices of the agency contacts listed below and the New City Library, 220 North Main Street, New City; the Nyack Library, 59 South Broadway, Nyack and Valley Cottage Library, 110 Route 303, Valley Cottage. The action involves the proposed Adoption and Implementation of a Master Plan for Rockland Lake, Hook Mountain, Nyack Beach and Haverstraw Beach State Parks. The draft plan includes proposals for both resource protection and recreational use. Recreational proposals include the complete rehabilitation of the North Pool complex and conversion of the South Pool complex into a court and field recreation area. Also proposed are improvements to both golf courses, the construction of two new playgrounds and improvements to picnicking areas, parking lots, comfort stations, and maintenance areas. The trail system and Nyack Beach parking area will be improved. A new park manager's residence will be identified and a new trailhead parking area and cultural resource center will be developed at Landing Road. The nature center will be rehabilitated and expanded. A Cultural Resource Plan will be developed and natural resource management strategies for water resources, invasive species and wildlife will be undertaken. Partnerships will be developed for improving interpretive opportunities and trail stewardship. The Draft Plan / Draft EIS describes potential environmental impacts and mitigation of those that may be adverse. Areas that have been evaluated with respect to impacts include: land and water resources, biological resources/ecology, scenic resources, historic/archeological resources, open space and recreation, traffic and access, public health and safety, and growth and character of the community and neighborhood. The project is located in the Town of Clarkstown, New York.

Notice of Acceptance of Final GEIS
Orange County - The Walden Board of Trustees, as lead agency, has accepted a Final Generic Environmental Impact Statement on the proposed 2013 Walden Comprehensive Plan. The Final GEIS is available from the Village of Walden Village Hall; the Josephine Louise Public Library at One Municipal Square, Walden, NY and on line at: http://www.villageofwalden.org/.
The action involves the adoption of a Comprehensive Plan Update for the Village. The Trustees prepared a Draft GEIS which was accepted as complete on November 27, 2012. A joint public hearing on the draft Comprehensive Plan and Draft GEIS was held on December 11, 2012 and the public comment period closed on December 27, 2012. Since no comments were received on the Draft GEIS, the Draft GEIS is incorporated by reference, in its entirety, as the final Generic Environmental Impact Statement (Final GEIS). The Village Board accepted the Final GEIS as complete on February 12, 2013 meeting and will place this matter on its February 26, 2013 meeting agenda to adopt this Findings Statement in order to conclude the procedural requirements of Part 617 of the State Environmental Quality Review Act (SEQRA). The project is located throughout the Village of Walden, New York.
