Notice of Public Comment Period on Proposed Environmental Audit Incentive Policy
The New York State Department of Environmental Conservation (NYS DEC) has proposed a commissioner policy that incentivizes environmental audits. This policy encourages regulated entities to audit their operations and adopt effective approaches to prevent violations, including environmental management systems and pollution prevention, thereby improving compliance with environmental laws statewide and protecting public health and the environment. To support these actions, this Policy reduces or waives penalties for violations that are discovered and disclosed voluntarily, or discovered during pollution prevention or compliance assistance and encourages regulated entities to engage, during the ordinary course of business, in an environmental audit program. This Policy also identifies incentives for regulated entities to go "beyond compliance" by agreeing to evaluate and incorporate environmental management and pollution prevention into their systems.
Pursuant to ECL 3-0301(2)(z), written comments regarding this proposed Commissioner Policy will be accepted until Monday, April 22, 2013. Comments should be submitted to: Monica Kreshik, NYS DEC - Office of General Counsel, 625 Broadway, Albany, New York 12233-1500 or OGCWEB@gw.dec.state.ny.us .
The proposed Commissioner Policy is available by writing Monica Kreshik at the address above or calling (518) 402-9507. A copy may also be found on NYS DEC's website at: http://www.dec.ny.gov/regulations/2374.html.
