Project Description:

The Department has received an application from Stanley Gridley to develop and operate a 10.18 acre surface gravel and topsoil mine within a 74 acre property in the Town of Corning. The project site is located at 11250 River Road, on the south side of River Road approximately 0.8 miles southeast of the Village of South Corning.

Excavation will be by front end loader, excavator, and drag line, with materials mined to a depth of 42 feet below the current surface, or approximately 30 feet below the local water table. Mining is proposed to eventually remove 150,000 cubic yards of sand and gravel from the mine site, over an approximately 10 year operational life. Material will be processed by washing, crushing, and screening. Prior to the start of processing operations, topsoil and overburden berms will be placed at the north and northwest borders of the mine area. Some topsoil will be sold, with sufficient topsoil, overburden, and silt from material washing retained for reclamation around the excavated pond. Reclamation plans show the berms along the north and northwest borders of the mine area remaining after final reclamation.

Final reclamation will convert approximately 7.5 acres of the mine area to a pond open water surface, with the water surface elevation dependent on groundwater level. The remaining Life of Mine area surrounding the pond will be graded no steeper than 1 vertical to 1.5 horizontal, and seeded to establish permanent vegetative cover.

Plans show grades that will retain storm water runoff within the mined area and allow infiltration into the soil. No off site discharges are proposed. There are no streams or NY State regulated freshwater wetlands within the Life of Mine area. Hours of operation proposed are 7 AM to 5 PM Monday through Saturday, with no work on Sundays or legal holidays.

The application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Corning.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Mar 15, 2013.

Project Description:

The applicant proposes to install approximately 67 cubic tons of medium stone revetment for scour protection along 200 lineal feet of the Tanglewood Lake impoundment structure, Arthur Frick Dam (DA# 049-4215), which is situated within the Class III, State Regulated Freshwater Wetland, RB-5. The project is located on their property located at Tanglewood Trail in the Town of Thurston, Steuben County.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
