Negative Declaration

Franklin County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Stark's Clay Pit will not have a significant adverse environmental impact. The action involves the renewal of an existing 17 acre Life-of-Mine clay mine, including a proposed expansion, increasing the Life-of-Mine by 34 acres, for a new total 51 acre Life-of-Mine on a 95.4 acre parcel of land owned by the permittee. The current affected area is 12.5 acres, with a maximum of 19.9 acres to be affected this term. The maximum depth of the excavation will be 12 feet deep. The mining will occur to 184 feet in elevation, which is same as water table level. There will be no material processing and no blasting on site. All surface water runoff will be retained on site. Setbacks from neighboring property lines will be a minimum of 25 feet. The mine will be reclaimed to ponds and open space.
