Negative Declaration

Suffolk County - The Town of Brookhaven Town Board, as lead agency, has determined that the proposed Swan River Restoration and Trailhead Project will not have a significant adverse environmental impact. The action involves the restoration of a parcel approximately 3.77 acres in size to natural vegetation, a more natural river bank and channel to create a passive parkland accessible to the public. Proposed work includes creation of an expanded wetland area, a forest, a drainage swale, pervious parking and trails, and a native old field. The project is located on the west side of the Swan River at 536 East Main Street in East Patchogue, Town of Brookhaven, New York.

Suffolk County - The Town of Brookhaven Town Board, as lead agency, has determined that the proposed Great South Beach in Fire Island National Seashore Code Amendment will not have a significant adverse environmental impact. The action involves the enactment of an Introductory Local Law Amending Chapter 85 of the Code of the Town of Brookhaven, entitled, "Zoning" by amending Article XVI, entitled, "Great South Beach in Fire Island National Seashore". The amendment will allow for reconstruction of pre-existing non-conforming structures on pre-existing conforming or non-conforming lots to rebuild in-place and in-kind without seeking variances so long as the proposed re-construction does not create further encroachments into the side, front, rear yards, height or lot area coverage. The project is located in the Residential Zoning District on Fire Island, Town of Brookhaven, New York.

Positive Declaration and Public Scoping

Nassau County - The Town Board of the Town of Oyster Bay, as lead agency, has determined that the proposed BK at Jericho Assisted Living Residences may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until February 27, 2013. A public scoping session will be held on February 13, 2013 at 7:00 p.m. at the Town of Oyster Bay Hearing Room, Town Hall, 54 Audrey Avenue, Oyster Bay, NY 11771.

The action involves an application for a change of zone from R1 1A One-Family Residence to General Business (GB) district and Special Use Permit to allow the construction of a 90 unit, 90 bed, 73,172 square foot assisted living facility on a 3.38 acre parcel. The proposed development includes 83 parking spaces (including 17 land-banked spaces), an interior courtyard, walkways and landscaped areas.

The proposed action has been modified from the prior application on which the Positive Declaration was based, which included a 140 bed, 97,000 square foot assisted living residence and the use of a separate parcel (104 Old Cedar Swamp Road) for parking.

The project is located at 1 and 141 Old Cedar Swamp Road in Jericho, Town of Oyster Bay, New York.
