The Department has prepared a draft permit and has made a tentative determination to issue a Title V Renewal 2 for a housing development consisting of approximately 15,000 apartments, three shopping centers and eight garages, all heated and cooled by the Power Plant. The facility operates five emission units: two low pressure boilers using #6 fuel oil or natural gas rated at 371 mmBtu/hr each; also, one high pressure boiler rated at 212 mmBtu/hr firing natural gas; also two Combustion Gas Turbines rated at 131 mmBtu/hr firing natural gas or ultra low 15 ppm sulfur by weight distillate fuel oil; and a black start emergency diesel generator. The facility's emissions exceed the major source pollutant thresholds listed in 6 NYCRR 201-6 and is subject to the provisions of Title V. The facility's emissions of Oxides of Nitrogen, Carbon Monoxide and Ammonia will be continuously monitored.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The applicant proposes improvements to the Red Hook shoreline, beginning at the south side of the Beard Street Pier, or Warehouse Pier, and extending north to the historic Pier 41 pier.The improvements have been designed to reduce overall filling and water coverage while stabilizing the shoreline and protecting upland structures. Area 1 includes the shoreline on the south/southeast side of the Warehouse Pier. The proposed work includes demolition of existing concrete paving, timber cribbing, and timber piles, and construction of a new riprap shoreline revetment to protect the pier and historic pier structures. Area 2 includes the outshore end of the Warehouse Pier, as well as the storm sewer outfall at Van Brunt Street. In this area the applicant proposes debris removal around an existing outfall pipe, repair of the pier apron at the outshore end of the pier and installation of riprap to stabilize the existing storm sewer outfall area.

The Department has prepared a draft permit and has made a tentative determination to issue a Title V Permit Renewal 2 (with revised Nox Ract Plan). The facility is a 1,844-unit cooperative apartment complex that includes an Integral Total Energy Plant owned and operated by management. The plant provides heat, air conditioning, hot water and electricity for the entire apartment complex. The plant consists of six 1,500 kilowatt engine-generators each rated at 14.55 mmBtu/hr heat input; four boilers rated at approximately 29.29 mmBtu/hr heat input, and one 10kW emergency power generator, plus seven underground fuel oil storage tanks.The boilers can fire either natural gas or fuel oil and are combined to a common stack. Oxides of Nitrogen emissions from this facility is 25 or more tons per year and is subject to Subpart 201-6, Title V Permits, 227-2, Reasonably Available Control Technology (RACT) for Oxides of Nitrogen (NOx). Annual NOx emissions from all engines are limited to 240 tons per year. Oxides of Nitrogen emissions resulting from the operation of the facility's boilers are limited, starting July 1, 2014, to 0.107 lb/mmBtu/hr on an annual average rolled monthly basis and is based on the NOx RACT variance of December 2011.

The facility's Carbon Dioxide equivalent emissions exceed 100,000 tons per year on an annual 10-month rolling basis and is subject to Title V permit requirements. The facility is limiting its NOx and HAP emissions to less than the major threshold and is capping out of the applicable requirements, 6 NYCRR Subpart 227-2 for NOx and NESHAPS for HAPS.
