Positive Declaration and Public Scoping

Kings County (Brooklyn) - Empire State Development (ESD), as lead agency, has determined that the proposed Atlantic Yards Arena and Redevelopment Project may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until March 14, 2013. A public scoping session will be held on February 27, 2013 at 5:00 p.m. at the St. Francis College, 182 Remsen Street, Founders Hall, Brooklyn, NY. Comments on the draft scope of work may be presented at the public scoping meeting or submitted in writing to: Empire State Development (Attn: Atlantic Yards), 633 Third Avenue, 37th Floor, New York, NY 10017 or e-mailed to: atlanticyards@esd.ny.gov. Copies of the draft scope of analysis may be obtained from ESD's website: http://esd.ny.gov/Subsidiaries_Projects/AYP.html or maybe requested by e-mailing: atlanticyards@esd.ny.gov.

The New York State Urban Development Corporation d/b/a Empire State Development (ESD) intends to prepare a Draft Supplemental Environmental Impact Statement (Draft SEIS) and hold a public scoping meeting for Phase II of the Atlantic Yards Arena and Redevelopment.

In an Order dated July 13, 2011, the New York State Supreme Court for New York County directed ESD to prepare a Supplemental Environmental Impact Statement (SEIS) assessing the environmental impacts of delay in Phase II construction of the Project; the conduct of further environmental review proceedings pursuant to SEQRA in connection with the SEIS, including a public hearing if required by SEQRA and further findings on whether to approve the Modified General Project Plan (MGPP) for Phase II of the Project.

The project is located in the Borough of Brooklyn, New York.
