Project Description:

The applicant proposes to establish a standard 25 foot setback from the property line within the eastern portion of their Pamelia site. The land will be used to construct a perimeter berm along the eastern boundary of the site and no excavations planned for this area. This expansion will result in a net addition of 5.2 acres of land to their life of mine boundary resulting in a new life of mine boundary area of 185.2 acres. The mine is a traditional stone quarry extracting the Lowville limestone and Pamelia dolostone by traditional stone quarry blasting techniques. This is an existing facility with the only change being the addition of the 5.2 acres to the life of mine boundary. Reclamation for this facility calls for the quarry to be flooded and all non flooded areas will be covered with overburden and topsoil. These areas will then be seeded with an approved USDA NRCS seed mixture. The life-of-mine area is proposed to be 185.2 acres.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit NY-0257711, pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). This modification also includes a permittee initiated modification to increase the monthly permitted flow limit from 0.110 MGD (million gallons per day) to 0.150 MGD based on an engineering evaluation of treatment plant capacity. This permit is being renoticed based on submission of additional information.
The Village of Copenhagen Wastewater Treatment Facility is an existing facility. Treatment consists of a bar screen and 2 aerated facultative treatment lagoons. Each lagoon is subdivided into 2 cells separated by a baffle. The four-cell system is operated in series. Treated wastewater is discharged to the Deer River, a class C water.
DEC proposes to incorporate the following modifications to this permit: Increase the permitted monthly flow limit from 0.110 MGD to 0.150 MGD; effluent limits for BOD5 and Suspended Solids have been revised from "equivalent secondary treatment" to "secondary treatment" standards; sampling frequency for pH, Temperature and Settleable Solids will be 5 times per week; monitoring for the lagoon under drain system increased from semiannual to quarterly; a Pollutant Minimization Program for Mercury has been added; Discharge Notification requirements have been updated; a monitoring location page has been added; permittee contact information has been updated; and permit pages have been revised to reflect current NYSDEC format and nomenclature.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
