Public Notice

Notice of Extended Public Comment Period

CWM Chemical Services, L.L.C.

In response to a number of written requests, the New York State Department of Environmental Conservation (NYS DEC) is hereby announcing the extension of the public review and written comment period for the 6NYCRR Part 373 Hazardous Waste Management Permit renewal application submitted by CWM Chemical Services, L.L.C (CWM) for its facility located at 1550 Balmer Road in Model City, NY. This comment period is being extended to allow the public more time to review this renewal application and the Draft Permit prepared by the NYS DEC. The written comment period which was originally to expire on January 28, 2013, is being extended an additional 60 days, and will now extend through March 29, 2013.

Facility Description and Proposed Action:

CWM currently owns and operates a commercial facility for the treatment, storage and disposal of hazardous and industrial non-hazardous wastes on an approximately 710 acre site in the Towns of Lewiston and Porter in Niagara County, New York. Wastes accepted at this facility are ultimately either disposed of in an on-site landfill or shipped to another appropriate facility for further processing and/or disposal. NYS DEC has prepared a Fact Sheet for the public's use which provides further details on the draft permit and associated opportunities for public involvement in the process.

Legislative Public Hearing and Public Availability Session

The legislative public hearing and availability session will be held on January 14, 2013 at the Lewiston-Porter High School located at 4061 Creek Road in Youngstown, New York as originally scheduled. The availability session will run from 4:00 p.m. to 5:00 p.m., with the first hearing session beginning at 5:00 p.m. and the second session beginning at 7:00 p.m. In the event that the High School is closed for the day or closes early due to inclement weather on January 14, 2013, the hearing and availability session will be held on January 16, 2013 at the same times.

Hard copies of the NYSDEC Fact Sheet, new draft permit and CWM's application are available for inspection at the NYS DEC's Albany and Buffalo offices; the Youngstown Free Library; and Porter Town Hall.

How to Provide Your Comments

Any interested person may submit comments in writing, or verbally at the legislative public hearing. All comments will be considered in making the final decision about issuance of the permit. Written comments about the draft Part 373 Hazardous Waste Permit must be sent to David Denk, NYS DEC - Region 9, 270 Michigan Avenue, Buffalo, NY 14203-2915. All comments must be submitted no later than March 29, 2013.

Negative Declaration

Niagara County - The City of North Tonawanda Common Council, as lead agency, has determined that the proposed Gratwick-Riverside Marina Docking and Infrastructure Improvements will not have a significant adverse environmental impact. The action involves a proposal to replace existing infrastructure at the Gratwick Riverside Park Marina as part of the Federal Boating Infrastructure Grant Program. The project includes the installation of approximately 700 linear feet of new steel sheeting to replace existing wooden walls, the dredging of approximately 3,650 cubic yards of marina bottom to allow easier boat access, and the installation of new boat docks to replace the substandard existing docks. The project also includes the replacement of electric and water servicing new boater pedestals, new restroom facilities, and a new asphalt pavement with improvements to marina park lighting and landscaping. The total project affects 5.56 acres of Waterfront District. The project is located at 1000 River Road (NYS Route 265) in the City of North Tonawanda, New York.

Niagara County - The Niagara Falls Planning Board, as lead agency, has determined that the proposed Covanta Niagara Rail-to-Truck Intermodal Facility Project will not have a significant adverse environmental impact. The action involves the intentions of the applicant, Covanta Niagara LP, to modify their existing Resource Recovery Facility (RRF) by acquiring approximately 15 acres of an adjacent inactive rail yard to construct a Rail-to-Truck Intermodal Facility (RTIF Project). The proposed RTIF Project will enable utilization of rail infrastructure servicing the area to more efficiently deliver up to 50% of the waste that is accepted and converted to electricity by the existing RRF. The RTIF Project will require environmental remediation of acquired property; the demolition of some existing foundations and a maintenance structure; the installation of new rail facilities; and construction of a new office/maintenance building, new roadways, utility connections from the existing RRF site, tipping hall modifications, a waste scale, pavement, parking, lighting and drainage systems. The new roadway will directly link the RTIF Project with the existing RRF via internal roads such that shipments of sealed containers can be offloaded from the trains onto trucks and transported into the tipping hall of the RRF before the sealed containers are opened. No increase in the RRF waste combustion capacity is proposed in conjunction with the RTIF Project, nor are any changes proposed to the type of waste the RRF is currently permitted to receive. The project is located 100 Energy Boulevard, City of Niagara Falls, New York.

Niagara County - The Niagara Falls Planning Board, as lead agency, has determined that the proposed Sale of 15 ± acres of vacant land at Packard Court will not have a significant adverse environmental impact. The action involves a proposal by Niagara Falls Housing Authority, the owner of an approximately 15.4 ± acre parcel of vacant land, which is proposed to be rezoned from multi-family R3-A (Residential) to OS (Open Space) for use by the Midtown Little League for up to 3 youth baseball fields, associated parking area and a 1,200 square foot concessions / rest room building. The project is located at 4200 Pine Avenue in the City of Niagara Falls, New York.
