The Department has made a tentative determination to modify the Ellicot Street Road and Townline Road Water District to increase the water supply allocation (take) from 15,800 gallons per day (MGD) to up to 1 million MGD from the Town of Batavia's water supply sources (the City of Batavia, the Erie County Water Authority, and the Monroe County Water Authority). For the Genesee Valley Agri-Business Park, this permit applies to that portion which is physically located within the Ellicott Street Road and Townline Road Water District. As a tentative determination, the Department will consider public comments prior to making a final decision.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

Project Description:

The Department has made a tentative determination to issue a modification to the SPDES permit issued to the Monroe County Water Authority (MCWA) for the East Side Water Supply facility located approximately 5000 feet south of Lake Ontario including the Water Treatment Plant on Basket Road and the Lake Water Pump Station (LWPS) on Lake Road to discharge approximately 1.3 mgd of filter backwash, water treatment wastewater, and collected stormwater, to Lake Ontario. Although the new water treatment plant is still under construction, the SPDES permit was public noticed in 2006 and issued in July 2008; the proposed permit modification to the 2008 permit includes increase in flow to 2.4 mgd from Outfall 001 and addition of .6 mgd to Outfall 005; changes to Outfall 001 including changes to the pH range and Total Residual Chlorine limits, addition of temperature monitoring due to addition of non-contact cooling water; changes to Outfall 002 including elimination of monitoring due to stormwater only outfall; the addition of new Outfall 003 from an oil/water separator at the LWPS sump; the addition of new Outfall 004 from LWPS screen wash and instrumentation; the addition of new Outfall 005 for supplemental irrigation at the Webster Golf Course and associated effluent limits; and the addition of two water treatment chemicals from Outfalls 001 and 005. As a tentative determination, the Department seeks comments prior to making a final decision. The file is available for review and comment at the NYSDEC office in Avon.
