The New York State Department of Environmental Conservation (NYSDEC) has reviewed the 6NYCRR Part 373 Hazardous Waste Management Permit renewal application submitted by: Nexeo Solutions, LLC, 3 Broad Street, Binghamton, New York 13902. The NYSDEC has made a tentative determination to renew the 6NYCRR Part 373 Hazardous Waste Management Permit to Nexeo Solutions, LLC. State regulations require that the public be given forty-five (45) days to comment on the draft Permit. The public comment period begins on date of this notice will extend for 45 days.


Facility Description And Proposed Action: Nexeo Solutions, LLC (Nexeo) is a commercial hazardous waste storage facility located in Binghamton, Broome County, New York, which collects hazardous and nonhazardous waste for storage and transportation to Permitted treatment/disposal facilities for proper disposition of the wastes. The facility is permitted to manage a maximum of 42,900 gallons of hazardous and non-hazardous wastes. NYSDEC has prepared a Fact Sheet for the public's use which provides further details on the draft Permit and associated opportunities for public involvement in the process.

This NYSDEC action is intended as a renewal of Nexeo's existing 6NYCRR Part 373 Hazardous Waste Management Permit. This new draft Permit will not authorize an expansion in size or capacity of Nexeo's Binghamton facility. The new draft Permit allows Nexeo to continue the management of hazardous and non-hazardous wastes at their Binghamton facility. The new draft Permit maintains the requirements, as stipulated in the existing Permit, for Nexeo to provide financial assurance for closure of the facility and for post-closure care of all on-site land disposal units, as well as for ongoing corrective measures to address historic contamination.

Tentative Determination: The NYSDEC has determined that the Nexeo's Permit application is complete and has made a tentative determination to issue the Permit renewal. The new draft Permit has been prepared pursuant to the applicable regulations in 6NYCRR Part 373-2 as well as with all other applicable hazardous waste management laws and regulations.

How To Provide Your Comments: Any interested person may submit comments; all such comments must be in writing. All comments will be considered in making the final decision about issuance of the Permit. Should the NYSDEC decide to issue the Permit, a response to any comments submitted will be given which will identify any changes from the draft versions of the Permit and will describe and respond to the issues raised. A notice of the decision will be sent to each person who submits written comments or who requests such notice. Comments about the draft 6NYCRR Part 373 Hazardous Waste Permit must be sent to: Mr. David Bimber, Regional Permit Administrator, NYSDEC Region 7, Division of Environmental Permits, 615 Erie Blvd. West, Syracuse, NY 13204. All comments and/or requests for a public hearing must be submitted no later than 45 days from date of this issuance.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Feb 11, 2013.

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit NY 002 0532, DEC Identification #: 7-3140-00005/00001, of Village of Marcellus Water Control Plant pursuant to 6 NYCRR Part 750‑1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The most significant proposed changes to the permit are as follows:
The draft permit contains total phosphorus limits as a result of the promulgated Phase II Onondaga Lake Phosphorus TMDL. The Village is required to meet a 12-month rolling average phosphorus limit of 3.2 lbs/day, effective December 31, 2016 and a monthly average phosphorus limit of 1.0 mg/l effective January 1, 2016.
Effluent disinfection has been changed from year-round to seasonal with the disinfection period from March 15 - October 15.
In-stream monitoring requirements for D.O., NH3, TKN and TDS have been removed.
