Project Description:

The Department has drafted a SPDES permit and made a tentative determination to approve this application for three existing treated wastewater discharges from the Erie County Highway Department of Public Works Angola Maintenance Center located at 8730 Delameter Road in the Town of Evans. Outfalls 001 and 002 are discharges of up to 200 gallons per day from oil/water separator treatment systems serving the maintenance garage and vehicle storage facility, respectively, to a Class D tributary of Big Sister Creek. Outfall 003 is a discharge of sanitary wastewater to groundwater after treatment by a septic tank/absorption field system. The Department is seeking public comment prior to making a final decision on permit issuance.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) has reviewed the Hazardous Waste Management Permit (6NYCRR Part 373) renewal application submitted by Durez Corporation (Durez) for its facility in the City of Niagara Falls, NY. The NYSDEC has made a tentative determination to issue the permit renewal to Durez. Durez currently owns and operates a commercial facility for the treatment, storage, disposal and incineration of hazardous and industrial non-hazardous wastes on its site in the City of Niagara Falls in Niagara County, New York. Wastes accepted at this facility are ultimately incinerated on-site or shipped to another appropriate facility for further processing and/or disposal. NYSDEC has prepared a Fact Sheet for the public's use which provides further details on the draft permit and associated opportunities for public involvement in the process available at http://www.dec.ny.gov/chemical/37554.html.

Comments from the public will be considered in issuing the final permit, and a notice of decision will be sent to each person who submits written comments or who requests such notice. A public hearing will be scheduled if warranted based on comments received. In addition, any person may request a public hearing. The request must be made in writing, stating the nature of the issues proposed to be raised in the hearing and be submitted to the contact person no later than the last date for public comment. Persons interested in the facility's operation can submit a written request to the contact person to be put on this Department's mailing list. The draft permit, application and fact sheet are available for public review during normal business hours at NYSDEC, Division of Environmental Permits, 270 Michigan Avenue, Buffalo, NY and NYSDEC, Division of Environmental Remediation, 625 Broadway, Albany, NY. Copies of the documents are also available at the Earl W. Brydges Public Library, located at 1425 Main Street in Niagara Falls.
