Section 401 - Clean Water Act Water Quality Certification

Project is Located:

Stuyvesant, Columbia County

Project Description:

The applicant is seeking a new Water Quality Certificate to operate and maintain the existing Stuyvesant Falls Hydroelectric Facility and to increase the operating capacity of the facility from 2.8 MW to 4.3 MW. The increase in capacity will be the result of the installation of a minimum flow turbine at the intake with a rated capacity of 50 cubic feet per second. The facility currently operates two base flow turbines connected to two 2.1 MW generating units. The facility will operate in run-of-river mode and provide a minimum of flow of 65 cfs from the project dam into the bypass reach. The applicant proposes several other environmental measures that are outlined in the Final Environmental Assessment (EA) issued by the Federal Energy Regulatory Commission (FERC) on December 5, 2012 and the draft Water Quality Certificate prepared by DEC staff. All application materials, the Final EA and the draft Water Quality Certificate are available for review upon request.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jan 04, 2013.
