Project Description:

The applicant proposes to renew an existing 17-acre clay mine which includes a modification to expand their life of mine by 34 acres, for a new total 51-acre life of mine. Temporary berms will be constructed along the perimeter to contain surface water onsite, and to provide visual screening. Mining excavation will be 6 to 12' in depth, using bulldozer or track-mounted hydraulic excavator and dump trucks. The existing haul road from Briggs Street will continue to be used for truck access. Hours of operation proposed are Mon-Fri 7:00 AM - 6:00 PM and Saturday 8:00 AM - 1:00 PM. A 54" diameter culvert will be installed for the Briggs Creek crossing. The reclamation will be to a series of connected ponds (4-10' deep) with shallow shelves on a 2:1 slope, with 4:1 slopes in deeper water. The above water areas will be reclaimed as open space with native grasses, with trees planted around the pond. The site is located on the south side of Briggs Street Road, approx 250 south of the Candadian border in the Town of Westville.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The Department has prepared a draft permit and has made a tentative determination to issue a renewal of the applicant's Title V Permit, including an updated review of Part 212 VOC RACT; a new Part 227-2 NOx RACT Plan; and updated Automatic Waste Feed Cut Off (AWFCO) limits based on the latest Notice of Compliance (NOC) for the Hazardous Waste Incinerators.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. Project Description:

The project sponsor has made application for a permit for a new discharge of one million gallons per day (GPD) of wastewater to the Hudson River (Class B) from their municipal water supply treatment facility located on 260 Bultler Road in Gansevoort. The Department has prepared a draft permit and has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.
