Project Description:

The Albany County Airport Authority currently discharges stormwater from numerous outfalls and also operates an onsite Propylene Glycol - Aerobic Treatment System and compost facility under authority of its State Pollutant Discharge Elimination System (SPDES) permit. The treatment system treats stormwater collected from areas of deicing operations. The Airport has requested the following modifications to its SPDES permit relating to stormwater outfalls and the compost facility: deletion of stormwater Outfall 011; relocation of existing compost facility to an area with better percolation rates; and return of compost liquids to existing on-site biotreatment facility instead of a remote treatment facility.

The Department has made a tentative determination to approve these modifications to the Airport's SPDES permit.This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance and as such, does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project Description:

The applicant requests a Freshwater Wetland Permit for potential impacts to the 100-foot buffer area of AP-8, a Class 2 wetland located within the Town of Poestenkill, Rensselaer County NY. Impacts will result from realignment and improvements to a existing residential subdivision roadway that are required by Town Code. Roadway work is proposed within a portion of the 100-foot buffer area disturbed by permitted mining activities, but proposed action will result in 0.07 acres of new impervious area not previously permitted as impact. The Department is requiring that deed restriction language be placed on three subdivision lots (Lots 9, 10, and 11) that contain portions of AP-8 and its 100-foot buffer area to prevent wetland and adjacent area disturbances on these properties.
