Project Description:

The Department has made a tentative determination to reissue a State Pollutant Discharge Elimination System Permit under Article 17 of the Environmental Conservation Law for discharge of up to 5,000 gallons per day of treated sanitary wastewater from the Best Western New Baltimore Inn, in the Town of New Baltimore, Greene County, NY. The original permit expired on January 1, 2008 and is being transferred to a different owner. The surface discharge is to a Class C tributary to the Coxsackie Creek. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant is proposing replace two existing asphalt plants with a new asphalt plant at the Masick limestone quarry which includes an aggregate processing facility and a lime production facility. The Air State Facility permit for this facility contains emission caps for nitrous oxides (NOx); particulate matter with a diameter of less than 10 microns (PM-10), and carbon monoxide (CO) to avoid the need for Title V permitting requirements. Additionally, this permit/application contains federal New Source Performance Standards (NSPS) for asphalt plants, New York State requirements for burning waste oil, and conditions monitoring dust control. The facility is located at 4860 NYS Route 30 in Middleburg, NY.
