Positive Declaration

Nassau County - The Town of Oyster Bay Town Board, as lead agency, has determined that the proposed BK at Jericho Assisted Living Residences may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves an application for a change of zone from R1 1A One-Family Residence to General Business (GB) district to allow the construction of a 118 unit, 140 bed, 97,000 square foot assisted living facility on a 4.87 acre property comprising two parcels of land separated by Old Cedar Swamp Road. The 3.38 acre south parcel would contain the assisted living building, resident amenities (e.g., swimming pool, golf putting green and walkways) and 46 parking spaces (12 of which would be land-banked); the 1.49 acre north parcel would contain 68 parking spaces serving the assisted living facility and a separate parking area with 50 parking spaces to be dedicated for use by students at Jericho High School which adjoins the subject property to the north.

The calculated parking requirement under the Zoning Code (at 0.75 space per dwelling unit and one space per employee on the maximum work shift) is 114 spaces, equal to the number of spaces provided on the proposed site plan (including the 12 land-banked spaces, but not including the 50 spaces to be dedicated to Jericho School District). The applicant's submissions indicate that variances would not be required for the proposed development with respect to the dimensional requirements of the GB district. However, the subject property is located in the Town of Oyster Bay's Aquifer Protection Overlay district, which specifies limits with respect to the removal of natural vegetation and coverage with impervious surfaces, among other standards; compliance with these requirements remains to be assessed. The project is located at 104 and 141 Old Cedar Swamp Road in Jericho, Town of Oyster Bay, New York.
