Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY0025437) for the surface discharge of treated wastewater to Willowemoc Creek, a class C(TS) water.

The Livingston Manor STP provides tertiary treatment for a design flow of 0.8 MGD. Treatment includes pretreatment by bar screens/grit removal, biological treatment by aerated lagoons and secondary sedimentation, followed by post aeration. Sludge is concentrated by thickening and applied to drying beds prior to disposal offsite.

DEC proposes to incorporate the following modifications to this permit: -Updated permit pages and conditions reflect current permit language, Department guidance, format and nomenclature. -CBOD5 limits have been revised to apply year-round instead of just during the winter season (Nov. 1st - May 31st). -The annual monitoring requirement for mercury in the existing permit has been removed. A mercury minimization program has been included in the permit in lieu of continued monitoring. -Effluent monitoring requirements for nitrate, nitrite, phosphorus and total dissolved solids based upon a request from the Delaware River Basin Commission has been added. These requirements are intended to maintain water quality for the special protection waters tributary to the Delaware River.

Project Description:

The project sponsor proposes to expand a existing horse boarding operation by constructing a sixteen stall horse barn, a farm equipment storage building with employee dwelling units, a modified sand ring, paddocks and associated utilities and stormwater structures. The facility will be accessed by a pervious gravel driveway that follows the existing bridle trail of which 2,000 linear feet will be within the State regulated 100' adjacent area of Freshwater L-7. Invasive species removal, wetland seeding and no-mow zones are being proposed to mitigate approximately 74,830 square feet of permanent disturbance to the regulated adjacent area. In addition, the project will be required to gain coverage under the State Pollutant Discharge Elimination System General Permit 0-05-001 for the subsurface discharge of 2250 gallons per day to septic tank and leach field.
