Project Description:

The applicant proposes to subdivide a 120,454 sq. ft. lot into three lots as follows: Parcel 1 = 40,000 sq. ft., Parcel 2 = 32,852 sq. ft, and Parcel 3 = 47,602 sq. ft. A dwelling currently exists on Parcel 1. NYSDEC regulated tidal wetlands exist at the site; however, Parcel 1 and the proposed building envelope for Parcel 2 are located beyond the jurisdiction of the Tidal Wetlands Act. The purpose of the proposed project is to create additional lots for residential development. The proposed project is located at 43 Atlantic Avenue in East Moriches, Town of Brookhaven in Suffolk County, SCTM# 200-861-04-01.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: Brookhaven Town Board of Zoning Appeals

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
