Project Description:

The Department has received and made a tentative decision to approve an application for a proposed project that consists of the construction of a low pressure grinder pump sewage collection system and approximately 32,600 linear feet of 6 inch high density polyethylene pipe and other appurtenances from Lime Lake to the Village of Franklinville. The proposed sewer line will at times cross Ischua Creek and its tributaries [Class C(t)] and be located within the 100-foot wide regulated Adjacent Areas of NYS Wetlands DE-1, DE-4 and DE-15 within the Towns of Machias, Farmersville and Franklinville. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought.

Project Description:

The Department has received an application for a permit modification for an additional approximately 1700 linear feet of concrete riprap, topsoil and seeding for repair and replacement of existing revetment to stabilize the Niagara River riverbank in Niawanda Park (behind City Hall). The existing permit was issued for the stabilization of approximately 700 linear feet of riverbank using the same methods and materials. Existing concrete slabs are proposed to be broken into medium sized pieces and used as riprap bedding material along with newly installed riprap. The proposed bank improvement project will also consist of bioengineering plantings that include Virginia Creeper and Dogwood stakes. The Department has made a tentative determination to approve this application. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.

The Department has drafted a SPDES permit and made a tentative determination to approve this application for three existing treated wastewater discharges from the Erie County Highway Department of Public Works Angola Maintenance Center located at 8730 Delameter Road in the Town of Evans. Outfalls 001 and 002 are discharges of up to 200 gallons per day from oil/water separator treatment systems serving the maintenance garage and vehicle storage facility, respectively, to a Class D tributary of Big Sister Creek. Outfall 003 is a discharge of sanitary wastewater to groundwater after treatment by a septic tank/absorption field system. The Department is seeking public comment prior to making a final decision on permit issuance.

Project Description:

Sustainable Biovolt, LLC, a joint venture of Forest City and quasar energy group, based in Cleveland, Ohio, proposes to install and operate the Buffalo BioEnergy Anaerobic Digestion System (ADS) located on North America Drive in the Town of West Seneca. The ADS will use microorganisms in the absence of oxygen to recycle energy from organic waste. The facility will accept liquid and solid biomasses such as food wastes, oil and grease and biosolids to be processed at the facility. The facility will use an internal combustion engine to convert biogas to electricity for sale to the open market. An Air State Facility permit application is also under review for this project for the emissions from the internal combustion engine, the backup flare, a biofilter and a boiler. Digested materials may be land applied on approved agricultural fields as a soil amendment. A separate permit application will be required to approve fields which may have digested materials applied to them. The Department has made a tentative determination to approve the Solid Waste Management and Air State Facility permit applications for the anaerobic digester facility and is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such this tentative determination does not signify Department approval for or endorsement for which a permit is sought.
