The applicant proposes a new 16.31-acre life of mine sand and gravel mine (surface unconsolidated material) on a 62-acre parcel of land owned by the permittee. Mining has occurred at this site previously. A maximum of 7.3 acres will be open or disturbed at any one time. Reclamation will be concurrent with mining. The estimated life of mine is 15 years. The maximum depth of the excavation will be 14 feet with 1V:3H slopes. All mining will remain a minimum of 5' above groundwater table. No on-site processing equipment (i.e. crushing/screening) is proposed. Mining will use front end loader, track backhoe/excavator and dump trucks. The mining operation will generate a maximum of 6 trips/hr, average of 2 trips/hr, and excavation activities will only be active during the non-winter months. The proposed hours of operation are Mon-Fri 7:00 AM to 4:00 PM, no weekends or holidays. The stormwater will be internally draining in the excavated areas. A SPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (GP-0-06-002) has been applied for. The site will be reclaimed to native grass plantings, suitable for residential development or revert back to a forested area. The mine is located in the Town of Mooers northwesterly of the Hamlet of Mooers Forks. Entrance to the mine will utilize an existing gravel-base road off from Davison Rd, approx 1700 feet west of the intersection with Blackman Corners Rd.

State Environmental Quality Review (SEQR) Determination:
Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
SEQR Lead Agency: NYS Department of Environmental Conservation
State Historic Preservation Act (SHPA) Determination:
A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:
Comments on this project must be submitted in writing to the Contact Person no later than Dec 07, 2012.
