Proposed disturbance to .67 acres of the 100-foot adjacent area of NYS Freshwater Wetland NB-34 (Class 2) for improvement of a historic road into a 16' wide driveway, to serve a proposed single family residence on 57 acre parcel. Proposed activities include placement of a 35'-4" wide X 11'-5" high arch culvert spanning Gidneytown Brook [H-94-4, Class C]. Proposed mitigation includes removal of earthen dike & replacement with open-bottom 7' wide steel culvert to accommodate wetland hydrology, removal of debris from the wetland, and removal of shale and cobbles from stream bank.

Project Description:
The project sponsor proposes to construct a 30 foot wide roadway (24 foot driving surface and 6 feet of shoulder) across a portion of NYS Freshwater Wetland CD-31 (Class II) and its 100 foot adjacent area, to allow access to an upland area for construction of a 15 unit townhouse development. Total proposed disturbance to the wetland is .058 acre, and to the wetland 100 foot adjacent area is approximately .2 acre. Hydrologic connectivity between the portions of the wetland to be bisected will be maintained through the installation of two 17 inch high, by 13 inch wide arch culvert pipes. No other disturbances within the wetland or its 100 foot adjacent area are proposed.

Conditions on Hudson River work outside of the marina basin will be required to avoid a taking of the NYS-endangered species Shortnose Sturgeon (Acipenser brevirostrum).
