Project Description:
Sustainable Bioelectric, LLC, a subsidiary of Quasar Energy Group , based in Cleveland, Ohio, proposes to install and operate the Niagara BioEnergy Anaerobic Digestion System (ADS) located on Liberty Drive in the Town of Wheatfield. The ADS will use microorganisms in the absence of oxygen to recycle energy from organic waste. The facility will accept liquid and solid biomasses such as food wastes, oil and grease and biosolids to be processed at the facility. The facility will use an internal combustion engine to convert biogas to electricity for sale to the open market. An Air State Facility permit application is also under review for this project for the emissions from the internal combustion engine, the backup flare, a biofilter and a boiler. Digested materials may be land applied on approved agricultural fields as a soil amendment. A separate permit application will be required to approve fields which may have digested materials applied to them. The Department has made a tentative determination to approve the Solid Waste Management and Air State Facility permit applications for the anaerobic digester facility and is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such this tentative determination does not signify Department approval for or endorsement for which a permit is sought.

State Environmental Quality Review (SEQR) Determination:
Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.
SEQR Lead Agency: Wheatfield Town Planning Board
State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:
Comments on this project must be submitted in writing to the Contact Person no later than Nov 08, 2012.
