Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0004103) for the discharge of remediated groundwater to tributary 6-1-3 of Newtown Creek, a class C water. Treatment at the facility consists of activated carbon adsorption.

DEC proposes to incorporate the following modifications to this permit: -First and last page of the permit have been administratively updated. -Effluent limits for pH range, Total Copper, Total Iron, Total Lead, Total Nickel and Total Zinc have been modified. -Effluent limit for 1,1,1-Trichloroethane has been added. -Monitoring for Total Dissolved Solids has been added. -A footnote has been added to distinguish between the calculated water quality based effluent limitation and the practical quantitation limit for Total Lead. -Best Management Practices have been removed because the previously permitted stormwater outfall has been eliminated.

Project Description:

The applicant proposes to replace their failing sanitary system with a replacement waste treatment system that includes a 3100 gallon grease trap, 750 gallon per day aerobic tank, pump tank, sand filter, chlorination tanks, and a discharge of 638 gallons per day of treated sanitary wastewater to the roadside ditch, a Class D waterbody, that drains into Onion Creek (ONT -117-19-8), a tributary of Black Creek, (ONT 117-19) at the applicant's restaurant located at 6120 Buffalo Rd. in the Town of Riga, Monroe County.

The Department has made a tentative determination to issue the permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
