Project Description:

The Department has received a Mined Land Reclamation application from Narde Paving Company for the expansion of the mine site known as the Pallidino Brewer Buchtel Pit. The applicant proposes to expand an existing 30.2 acre sand and gravel mine by 9.4 acres to 39.6 acres within properties totaling 175.5 acres. The proposed expansion will include approximately 4 acres of affected areas outside the current Life of Mine area. The project site is on the Robert Brewer and Paul Buchtel properties, at 3010 Lake Road, between Newtown Creek and NYS Route 17, in the Town of Horseheads.

Operation of the mine will continue surface extraction of gravel from as much as 30 feet below the local water table, and will enlarge the existing 14.4 acre pond on the mine site to approximately 28 acres, based on mining plan and reclamation plan contours. Excavation will be by front end loader, excavator, and drag line below the water surface. Mining operations will remove over 1 million cubic yards of additional material from the Life of Mine area. Material will continue to be processed by washing, screening, and crushing on the site, with wash water being returned to the expanding pond. Hours of operation will continue to be Monday through Saturday from 7 AM until 5 PM with no mining permitted on Sundays. No change in truck traffic volume is proposed. Final reclamation will restore the site to meadow surrounding the enlarged pond. Reclamation will include the replacement of stockpiled topsoil and re‑seeding of the area around the pond.

The application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Horseheads.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The applicant proposes to rehabilitate the former Shangri La Harbour Marina located at 1 North Franklin St. in the Village of Watkins Glen, Schuyler County. The project includes dredging the approximately 13,000 square foot docking basin to a maximum depth of 10 feet and using sheet pile to reface the basin retaining walls, rebuilding the 13 dock slips and removing the failing stone/concrete breakwater, and installing 353 lineal feet of sheet pile within 12 inches of the face of the old failing lakeside breakwall with stone toe protection at its base for scour protection.

Project Description:

The Department has received an application from Donald Woodard to resume operation of an 8 acre sand and gravel mine on an 11 acre property previously owned by Kevin Lessord, who operated the mine at the site from 2001 until 2006. The mine site is located on the west side of South Street, approximately 3000 feet north of the intersection of Quarry Road. Mining operations at the site will continue as previously permitted, with excavation by mechanical equipment, and crushing and screening of the excavated material at the site. Mining operations are proposed to remove approximately 145,000 cubic yards of sand and gravel over the operational life of the mine.

The applicant has estimated truck traffic from hauling operations to be a maximum of 10 trucks per hour, as in previous operations.

Mining is not proposed to a depth below the local water table. Cross sections show grades that will retain storm water runoff within the mined area and allow infiltration into the soil. No off site discharges are proposed. There are no NY State regulated streams or freshwater wetlands within the Life of Mine area.

Hours of operation proposed are 7 AM to 5 PM, Monday through Friday, and 7 AM to noon on Saturday. Final reclamation to agricultural land is proposed, and will include the replacement of stockpiled topsoil and seeding with an approved mixture.

The application is available for review at the Region 8 NYSDEC office.
