Project Description:

Two Class B protected tributaries to the Mahwah River - Brian Brook and an unnamed stream - traverse the 208 acre project site, known as Patrick Farm. The development proposal, which consists of 497 residential units, includes several disturbances within the bed and/or banks of these two streams, requiring the above referenced DEC permits. The proposed disturbances include:

1. Reconstruction of On-Site Dam - An approximately 5 acre pond is located at the headwaters of the unnamed tributary. To provide additional water storage and flood protection, it is proposed to reconstruct and improve the existing failed dam. The failed earthen dam will be replaced with a concrete retaining wall and will be two (2) feet higher than the existing impoundment.

2. Replacement of the Culvert Passing NYS Route 202 - A five (5) foot wide concrete box culvert currently passes the unnamed tributary beneath NYS Route 202. It is proposed to replace this culvert with a 10 foot wide box culvert because the existing will only pass flows associated with a 25 year storm event. Approximately 800 square feet of temporary disturbance to the bed and banks of the stream is proposed.

3. Rock Rip-Rap Outlet Protection - Development of the site requires the construction of stormwater management basins. One such basin will discharge to the banks of the unnamed tributary to the Mahwah River. To prevent scour, a concrete headwall and rip-rap splash pad will be constructed, resulting in approximately 100 square feet of permanent disturbance to the stream bank.

4. Roadway Crossings - To provide connectivity between the portions of the site that are bisected by the two streams, it is proposed to install an open bottom, three-sided culvert in each stream, to accommodate roadway crossings. The regulated disturbances include excavation for the installation of abutments on either stream bank. No disturbance to either stream bed is proposed.

A draft environmental impact statement has been prepared on this project and is on file.

SEQR Lead Agency: Ramapo Town Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has made a tentative determination to issue a modified permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation law for the wastewater treatment plant located on Waverly Avenue in Monticello, Sullivan County, New York.

The applicant proposes improvements to the wastewater treatment plant. Design flow will remain the same, but the secondary treatment process will be improved to include Sequencing Batch Reactors (SBRs) with both nitrification and de-nitrification employed rather than a system of oxidation ditches. The Department's tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

A draft permit is available for inspection and comment at the DEC Region 4 Office.
