Project Description:

Triumvirate Environmental (NYC), LLC (Triumvirate) is a commercial hazardous waste storage facility, which collects hazardous and nonhazardous waste generated by schools, research laboratories, hospitals, auto repair shops, power plants, and other industries for storage and transportation to permitted treatment/disposal facilities. As part of its operations Triumvirate consolidates specific waste streams from smaller containers into larger containers for transportation efficiency, managing a maximum of 33,659 gallons of hazardous and non-hazardous wastes. The facility has been in continuous operations since 1964. Facility operations include ongoing corrective measures for historical on site contamination.

This proposed action is a renewal of Triumvirate's existing 6NYCRR Part 373 Hazardous Waste Management Permit, EPA ID No. NYD0777444263. The renewal does not authorize an expansion in size or capacity of Triumvirate operations, but allows for the continued management of hazardous and non-hazardous wastes at the Astoria facility.

NYSDEC has prepared a Fact Sheet which provides further details on the draft Permit and the review process. As a condition of the existing permit Triumvirate must provide financial assurance for closure of the facility and for post-closure care of all on-site land disposal units, as well as continuing corrective measures.

Tentative Determination:

The NYSDEC has made a tentative decision to issue the Permit renewal. A draft Permit has been prepared pursuant to the applicable regulations in 6NYCRR Part 373-2 (Final Status Standards for Owners and Operators of Hazardous Waste Treatment, Storage and Disposal Facilities) as well as with all other applicable hazardous waste management laws and regulations.

How to Provide Your Comments:

Any interested person may submit comments. All comments in response to this notice must be in writing. All comments will be considered in making the final decision about issuance of the Permit. Should the NYSDEC decide to issue the Permit, a response to any and all comments submitted will be given which will identify any changes from the draft versions of the Permit and will describe and respond to the issues raised. A notice of the decision will be sent to each person who submits written comments or who requests such notice.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Dec 03, 2012.
