Project Description:
The applicant proposes to remove sediment that has accumulated in the pond since the last dredge event in 1979, and dispose of this material at an appropriate upland location. The project also involves repair of existing weir structures to maintain water levels, implementation of slope and shoreline stabilization measures, repair and installation of additional drainage structures and other measures to prevent sediment from entering the pond, and wetland restoration involving removal of phragmites and other invasive species followed by plantings of appropriate vegetation around the edge of the pond. NYS regulated Tidal Wetlands and Freshwater Wetlands are located in the project area. The project is located at Scudder's Pond, which is east of Shore Rd., south of Littleworth Ln., Sea Cliff, Town of Oyster Bay, Nassau County.

The Department has made a tentative determination to modify the permit for an existing discharge of 1,000,000 gpd of non-contact cooling water, 30 gpd of boiler blowdown and stormwater to groundwater at the applicant's facility located at Forest Laboratories, Inc., 500 Commack Road, Commack, NY. New information recently submitted to the Department indicates the permit should be modified to include, a new limit for flow, sampling for Diethylethanolamine, the discontinuance of sampling for total suspended solids, and a comprehensive change in sampling frequency. Refer to this application by the application number listed above and SPDES number, NY0226424. The proposed discharge is located within an area designated as a sole source aquifer. The following water purveyors have been identified as having service areas located within a 3-mile radius of the applicant's facility: Suffolk County Water Authority.
