Project Description:

The Department has received a Mined Land Reclamation application from Montemorano Bros Inc for the expansion of the mine site known as The Flats. The applicant proposes to expand an existing 228 acre topsoil, sand, and gravel mine by a total of 8.7 acres to 236.7 acres within properties totaling 333.75 acres. The proposed expansion consists of a 0.8 and a 7.9 acre area to be added to the northeast end of the current Life of Mine area. The expansion area is on one of the Montemorano properties, on the east side of Lake Corners - Rose Valley Road.

Operation of the mine into the expansion areas will continue surface extraction of topsoil, sand, and gravel from above and below the local water table, adjacent to previously approved excavations creating ponds on the mine site. Excavation will be by bulldozer, front end loader, and hydraulic excavator. Mining operations will remove approximately 100,000 cubic yards of additional material from the expansion areas. Material processing is not proposed. Hours of operation will continue to be Monday through Friday from 7 AM to 6 PM, and Saturdays from 8 AM to 2 PM with no mining Sundays and holidays. No change in truck traffic volume is proposed. Final reclamation will restore the expansion area to mostly meadow or brush land adjacent to the excavated ponds. Reclamation will include the replacement of stockpiled topsoil and re‑seeding of the area adjacent to the ponds.

The application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Galen.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Nov 09, 2012.
