Positive Declaration

Wayne County - The Town of Arcadia, as lead agency, has determined that the proposed Sale of 6359 Rohlin Lane to Arcadia Hills, LLC; Modify or Repeal of Local Law No. 1 for the year 2006 may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The Lead Agency has combined two actions which it has determined are reasonably related for evaluation in a single environmental impact statement.

First Action: Sale of approximately 161 acres of real property located on the east side of NYS Route 88 North in the Town of Arcadia, commonly known as No. 6359 Rohlin Lane, Newark, NY 14513 for eventual construction and development by Arcadia Hills, LLC of a privately owned and operated solid waste management facility.

Second Action: Adoption of a local law to modify or repeal Local Law No. 1 for the year 2006, which is commonly known and cited as the "Solid Waste Management Facilities Law of the Town of Arcadia" and which currently prohibits the siting, construction and operation of solid waste management facilities in the Town of Arcadia.

The project is located at 6359 Rohlin Lane in Newark, Town of Arcadia, New York.
