Project Description:

The Department has made a tentative determination to approve an Air State Facility application for an existing facility that currently holds a Title V Permit; the facility emissions can be capped below Title V Permit applicability thresholds. The facility is a repair and maintenance facility for NYCT subway cars, buses and non-revenue vehicles. Included is combustion installation consisting of three boilers with heat input capacity of 47.3 mmBtu/hr firing natural gas or #6 fuel oil; five diesel emergency generators; a gasoline dispensing station; and cold cleaning degreasing units to clean parts. All generators are emergency generators used to provide back up power during power outages and their operation is limited to not more than 500 hours per year each. The facility NOx emissions are capped at 24.9 tons per year and the facility is subject to the provision of State Facility requirements specified under 6NYCRR 201-7.2. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

State Environmental Quality Review (SEQR) Determination:

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Title V Renewal 2 for a facility that provides heating, cooling, hot water and electricity to a residential apartment complex consisting of ten twenty-two story residential buildings. The facility operates two dual fuel boilers with 31 mmbtu/hr each; two dual fuel chillers/heaters with 10.4 mmbtu/hr heat input each, and six diesel engine generators, and four new 820 KW natural gas powered engine generators. Under Renewal 1 Mod 1, emission sources 00008, 00009 and 00010 are allowed to burn dual fuel (35 to 50% max Natural gas and the balance #2 oil). The six existing diesel engines/generators are required to meet a NOx limit of 2.3 grams/brake horsepower-hour under Subpart 227-2. The facility has applied for a variance due to economic and technological reasons for an alternate NOx emission limit of 6.0gr/bhp-hr. This variance was granted by the Department pending EPA's final approval.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
