Project Description:

The project involves removal of vegetative debris and invasive species in a tributary to Lake Erie to improve drainage at the Lake Shore Road culvert. Also, a trapezoidal channel with an 8 foot bottom width, 16 foot top width and 2:1 side slopes will be created from the culvert to approximately 200 feet downstream. The work area will be within New York State Freshwater Wetland AN-3.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Oct 04, 2012.

Project Description:

The applicant proposes to remove some small woody plants and to place woodchips to maintain an existing All Terrain Vehicle (ATV) trail and a fire pit area that are used for occasional outdoor recreation activities. The proposed project area is located at 4150 Mapleton Road in the Town of Pendleton. The proposed ATV trail maintenance will consist of the placement of approximately 360 square feet of wood chips in various areas along the trail. In addition, the applicant proposes to place approximately 200 square feet of wood chips within a fire pit area. Portions of the trail and fire pit are located within New York State Freshwater Wetland TE-28 or its 100 foot wide adjacent area. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought.
