Project Description:
The Department has received an application from David W. Bowers for a 2 acre expansion of an existing topsoil mine on South Corning Road (County Route 10). The current permit authorizes operation in a 24.9 acre life of mine area. The 2 acre expansion proposed will increase the life of mine area to 26.9 acres.
Excavation is proposed to remove approximately 32,000 cubic yards of topsoil from the 2 acre expansion area over the next 10 years. Material will continue to be processed on the site and the expansion will continue current operations.
Mining is not proposed below the local water table. An undisturbed buffer 100 feet wide will separate mining operations from the Chemung River to the north of the expansion area. Proposed final contours show grades that will retain storm water runoff within the mined area. No off site discharge of storm water runoff will be permitted. There are no NY State regulated streams or freshwater wetlands within the expansion area.
No change has been proposed in hours of operation. Final reclamation to open meadow is proposed, and will include seeding the remaining topsoil with an approved mixture.
The application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Big Flats.

State Historic Preservation Act (SHPA) Determination:
A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The applicant proposes the construction of an interconnection between two existing natural gas pipelines located within the New York State regulated freshwater wetland (CI-5) adjacent area. A temporary construction entrance will be constructed along Ballantyne Road. Installation of the new interconnect will involve temporary impacts to approximately 0.03 acres of wetland adjacent area.
