Project Description:

The applicant proposes to operate a 37 acre sand and gravel mine within a 82 acre parcel along Webatuck Creek, west of Route 2 in the Town of Amenia. The entrance to the site is about 0.2 miles south of and across the highway from Clark Hill Road. The mine will be worked in seven phases using standard sand and gravel excavation methods. Processing on site will include screening and crushing.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Westchester Recycling Services, Inc. proposes to construct and operate a 1,000 ton per day (tpd) construction and demolition debris (C&D) processing and transfer facility. C&D includes brick, concrete, masonry, soil, rock, wood, land clearing debris, glass, ferrous and non-ferrous metals, and other materials associated with construction and demolition activities. C&D does not include industrial wastes, asbestos, regulated medical waste, petruscible waste, or hazardous wastes. All processing is proposed to occur within an existing building located on-site, and within a proposed 34,000 square foot extension to this building. The proposal includes 24 hour operations, six days per week (exclusive of Sundays).

A draft Stormwater Pollution Prevention Plan (SWPPP) has been prepared to facilitate the treatment and discharge of stormwater from the site in accordance with the Multi-Sector General Permit for Stormwater Discharges from Industrial Activity. Stormwater from the site is proposed to be discharged to the Saw Mill River [Class B(t)], requiring the installation of an outfall pipe on the river bank.

This project is subject to the Department's Environmental Justice Policy and an enhanced public participation plan has been prepared and accepted as a component of application completeness.
