Project Description:

The applicant proposes installation of a water distribution system to serve Phase 1 of the newly created Town of Pomfret Water District No. 7 (also known as the North End Water District), and the purchase of up to 55,000 gallons per day from the Village of Fredonia. Water District No. 7 comprises approximately 1025 parcels in the northern portion of the Town of Pomfret, exclusive of the Village of Fredonia and other existing water districts. The Department intends to issue a Protection of Waters Permit (DEC ID #9-0658-00208/00002) to support the Water Supply Permit, for various stream crossings during the installation of approximately 58,000 linear feet of watermain and related appurtenances.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Pomfret Town Board

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Sep 27, 2012.

Project Description:

The proposed action involves the excavation within NYS wetland TW-4 and its 100-foot adjacent area of a 650 foot long channel to recreate the original drainage path north of the Niagara County Landfill and the addition of an 18 inch overflow pipe to connect the northern to the southern drainage system in the Town of Wheatfield.

Approximately 680 cubic yards of spoil will be excavated from the drainage channel and removed from the site for the proposed flood mitigation project. The excavation will impact 0.408 acre of wetland and 0.088 acre of the regulated 100-foot adjacent area. The project will require temporary filling of 0.039 acre of wetland and 0.038 acre of adjacent area, as well as permanent filling of 0.005 acre of wetland and 0.022 acre of adjacent area. Mitigation for these impacts will include 0.451 acre of wetland and adjacent area restoration, including tree and shrub plantings, and 0.088 acre of wetland creation. The site is located west of Witmer Road, north of Niagara County Landfill in the city of North Tonawanda. The Department has made a tentative determination to approve this application and is seeking public comment prior to making a final decision on permit issuance.
