Project Description:

The applicant proposes to install two new clusters of wooden piles to protect the pier's fendering system and assist in docking side loading vessels and additionally proposes a new end use for the pier primarily consisting of commercial catering and restaurants inside the recently refurbished building. Water dependent uses include possible ferry service and historic ship docking at the pier as well as a visitor's information center focused on maritime history in the plaza. No residences will be created at the site and all new uses will occur within the existing building, so there will be no expansion of the building footprint on the pier.

Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Title V Renewal 2 Permit for a municipal solid waste landfill operated by the NYC Dept. of Sanitation (DSNY). The landfill occupies approx. 2,200 acres along the Fresh Kills estuary on Staten Island. Closed in December 2001, it continues to generate methane containing landfill gas (LFG) from the anaerobic degradation of solid waste. Six LFG flares are installed at the landfill and there is an existing LFG processing facility. There are two landfill leachate treatment plants, three landfill vehicle maintenance and repair garages, a rock crushing and screening operation, a yard waste composting facility and two refueling stations for landfill vehicles. The three garages are operated by DSNY and are equipped with boilers with ratings ranging from 2.8 to 10.5 MMBtu/hr. using No.2 fuel oil or natural gas.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
