Project Description:

The applicant proposes to replace their failing sanitary system with a replacement waste treatment system that includes a 3100 gallon grease trap, 750 gallon per day aerobic tank, pump tank, sand filter, chlorination tanks, and a discharge of 638 gallons per day of treated sanitary wastewater to the roadside ditch, a Class D waterbody, that drains into Onion Creek (ONT -117-19-8), a tributary of Black Creek, (ONT 117-19) at the applicant's restaurant located at 6120 Buffalo Rd. in the Town of Riga, Monroe County.

The Department has made a tentative determination to issue the permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance.

As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Project Description:

The applicant is proposing the development of a 6-lot subdivision on the site of the old Glen Edith Restaurant, the majority of which is located within previously impacted portions of the regulated NYS Freshwater Wetland (RE-1) 100 foot adjacent area. As part of the project six (6) open pile docks are proposed along the waterfront, four of which would be 200 square feet in surface area, one which would be is 192 square feet in surface area (with an attached boat hoist) and one that would be 408 square feet in surface area. The Town of Webster has granted Final Approval for the proposed project. Additionally, the U.S. Army Corps of Engineers has approved the proposed docking under LRB#2011-01464.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

The Department has made a tentative determination to transfer and re-issue the permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall project.
