Project Description:

The Department has prepared a Draft Title V Permit renewal for Al Turi Landfill & LFGTE Facility pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments. The Al Turi Landfill & LFGTE (the "facility") consists of a privately owned municipal solid waste landfill (the "landfill"), which is owned and operated by Al Turi Landfill, Inc. ("Al Turi") and an adjacent landfill gas to energy (the "LFGTE Plant"), which is owned and operated by Ameresco LFG-1, Inc. ("Ameresco"). This facility is located in Goshen, Orange County and accessed at 2690 Route 17M. The subject of this Title V Permit Renewal 2 relates to the landfill and the associated operation of the gas collection system. The landfill consists of approximately 100 acres of landfill footprint area which began documenting waste acceptance in 1963. The facility is currently at capacity with approximately 5.5 million megagrams of refuse in place. In the fall of 2002, the landfill's solid waste permit expired. A Part 360 cap or equivalent has been installed over the entire landfill proper. Installation of landfill gas collection components is complete. This consists of approximately 112 vertical wells, and a series of horizontal collectors, laterals and headers. The gas collection material is constructed of PVC and polyethylene piping. There are two electric 100 horsepower Lamson blowers which provide vacuum to the collection system.

Municipal Solid Waste Landfill Gas Collection and Control under 6 NYCRR Part 208 applies to this facility. Requirements identified within this Title V Permit Renewal 2 includes but not limited to: monthly monitoring at each well head for pressure, oxygen and temperature, implementation of startup, shutdown and malfunction procedures relevant to the collection system as well as annual surface methane monitoring around the perimeter of the collection area and along a pattern which traverses the landfill.

The Standard Industrial Classification representative of the landfill is 4953 - Refuse Systems.

Control of landfill gas is required and is regulated by a separate Title V Permit under DEC ID No. 3-3330-00184/00002.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

DEC will evaluate the application and comments received on it to determine whether to hold a public hearing. Project Description:

The applicant proposes the following culvert replacements/modifications to 4 existing culverts to accommodate the installation of a pedestrian sidewalk:

1. Culvert # 1 (numbered from east to west): this culvert will consist of constructing a concrete wall over the top of the existing culvert barrels that structurally supports the sidewalk. The concrete wall will be constructed above the spring line of the four existing culverts and will not affect a tributary of Sparkill Creek, WI # H-13 portion, a Class C(T) waterbody.
2. Culvert # 3: This culvert consists of two existing culverts that will be extended approximately 21 feet to allow proper grading for the sidewalk, and is passage-way for a tributary of Sparkill Creek, WI # H-13-7, a Class B waterbody. In addition, new roadside drainage will outlet to the same area with two new outlet pipes. This area will require minor temporary excavation.
3. Culvert # 4: This consists of a single culvert pipe that will be intercepted by a new catch basin at the curb edge. A new culvert will lead from catch basin and extend approximately 12 feet beyond where the existing culvert ends.
