Project Description:

The applicant proposes to construct a new on-site wastewater treatment plant with a surface discharge of 35,000 GPD for treated wastewater from the production plant to outfall to the Susquehanna River. Construction of the effluent line involves directional boring through NYS Regulated Freshwater Wetland. This also includes the modification of the facilities original outfall (outfall 002) septic tank and leach field, once the new treatment plant is online, the discharge to outfall 002 will be decreased to 3,800 GPD. The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute if considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. Refer to this application by application number listed above and SPDES number, NY 02 60509. A draft permit is available for review and comments at the address below.

Project Description:

The applicant proposes to operate a new 10.8 acre life-of-mine sand and gravel mine of which 10.8 acres is proposed to be affected during the initial permit term. Processing of material will consist of a small portable screening crusher unit and will occur no more than 5 days per year. Grass vegetation will be established for final reclamation and future planned use for the mine site will be agricultural production. The mine is located west of State Route 28 on the north side of Oxbow Road, 1/2 mile north of the Village of Milford, Otsego County.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
