Project Description:

The Department has received permit applications associated with the development of a proposed 195 lot residential subdivision on parcels located at 100 Tonawanda Creek Road, part of 170 Tonawanda Creek Road and 3505 Niagara Falls Boulevard. The proposed project includes the construction of three storm water outfall pipes to Tonawanda Creek from the storm water management system. Existing vegetation will be maintained along the stream bank. The proposed project also includes impacts to approximately 0.9 acres of the regulated 100 foot adjacent area of NYS Freshwater Wetland (FWW) TE-45 associated with the development of several lots, construction of a storm water retention pond and a proposed turn-around at the western terminus of one of the subdivision roads. There will be no direct impact to FWW TE-45. The applicant proposes to establish three mitigations areas which will be left fallow and also proposes native conifer plantings between the storm water retention pond and FWW TE-45 and between the turn-around and FWW TE-45 to establish a buffer to protect the wetland. Appropriate sedimentation and erosion controls will be utilized to maintain the water quality of the wetland and stream resources.

The Department has made a tentative determination to approve these applications. As a tentative determination, the Department is seeking public comment prior to making a final decision regarding permit issuance.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0020419) for the surface discharge of 0.312 mgd of treated wastewater to Lake Ontario, a class A-Special water.

Treatment at the facility consists of grit screening (aerated grit chamber and comminutor), primary settling (clarifiers), rotating biological contactors (three RBC units), final settling (clarifiers), excess flow tanks, and chlorination (contact tank), before discharge to Lake Ontario. Sludge is dewatered by a felt filter press and disposed at Modern Disposal Services (with grit from raw inflow).

DEC proposes to incorporate the following modifications to this permit: -Interim and final limitations for Total Residual Chlorine (TRC) in accordance with upgrade of disinfection capacity. Water quality based final TRC limit. - Mixing zone information added for WQBEL calculations. - updated forms that incorporate the latest General Conditions.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to approve an application for renewal of an Air Title V Permit for Morton Salt, Inc. This renewal will incorporate new emission requirements of 6NYCRR Part 227-2 (Reasonably Available Control Technology) for major facilities. Morton Salt packages and ships salt products for consumer and industrial uses.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.
