Project Description:

The applicant proposes to conduct various maintenance activities at the Cannonsville Dam. These activities include dam inspections, mowing of the grassed area of the dam, woody growth removal on the waterward face of the dam, winter maintenance (snow plowing and sanding of access roads) visual inspections of the dam, minor repair projects, gate tower exercises, repair work on buildings, etc. The Department has determined that the proposed activities are likely to result in the incidental take of Bald Eagle habitat as identified in 6 NYCRR Part 182. Pursuant to Section 182.11 of the same regulations, a permit is required for this taking. The applicant has prepared an Endangered Species Mitigation & Conservation Plan. The project is located at the Cannonsville Dam off State Route 10.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification to the State Facility Permit for the operation of Getty Terminals Corp facility located at 49 Riverside Drive, City of Rensselaer, County of Rensselaer, owned by Getty Petroleum Marketing Inc. This facility is a bulk terminal handling a variety of petroleum products for transfer and distribution. The modification includes the addition of a federally enforceable emission cap to ensure that new vapor recovery device does not exceed the proposed emission rate of 8 mg/liter of gasoline loaded to maintain emission throughput caps at the facility. Also the modification includes the addition of 40 CFR 63, Subpart BBBBBB federal requirements.

Persons wishing to inspect the subject Air State Facility, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Project Description:

Construction of a 10,000 sq. ft. retail plaza with associated parking and appurtenant features, which would result in the discharge of fill into 0.09 acres of wetland adjacent area (as well as 0.41 acres that were previously disturbed), and the planting of a vegetative barrier between the remaining wetlands and development. The project is located at 141 West Campbell Road in the Town of Rotterdam, Schenectady County.

SEQR Lead Agency: Rotterdam Town Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
