Project Description:

The applicant proposes a new 17.35-acre top soil mine in the southwest portion of a 73.74-acre parcel owned by Steven Benway. Approximately 4" of topsoil will be extracted from the existing 12" top soil layer of an agricultural field. An existing 12' wide gravel road will be used for access from Middle Road. Hours of operation will be 7:00 AM - 3:30 PM. The reclamation plan is to return the land to agricultural use (hay crop). The project is located at 1105 Middle Road in the Town of Willsboro. The project is also under review by the Town of Willsboro as a Class B regional project under their APA-Approved Local Land Use Program.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Sep 14, 2012.

Project Description:

Proposed construction within 1.20 acres of the adjacent area of Freshwater Wetland TH-7 (Class 2), for redevelopment and expansion of the existing Eagle Chevrolet dealership. Of the 1.20 acres of wetland adjacent area, 0.71 acre is currently paved and used for parking. The new 0.49 acre disturbance is for additional parking and a stormwater management basin. The project is located on the east side of NYS Route 30A, 300 feet south of NYS Route 67, City and Town of Johnstown.

No further review in accordance with SHPA is required.
