Proposed Re-issuance and Modification of the New York State Department of Environmental Conservation (NYS DEC) - Region 5 Fresh Water Wetlands General Permit

NYS DEC - Region 5 proposes to modify and re-issue the region-wide Fresh Water Wetlands (FWW) General Permit (GP) for groups of activities regulated under Environmental Conservation Law (ECL) Article 24 (Freshwater Wetlands) and Article 15, Title 5 (Protection of Waters). A State Environmental Quality Review Negative Declaration has been prepared, and is on file, for the GP.

The FWW GP 5-12-003 will be utilized by NYS DEC staff to reduce the need for repetitive project reviews for routine activities. A project subject to this FWW GP would only be authorized after staff determines that the proposal will meet permit issuance standards in the implementing regulations contained in 6 NYCRR Part 663 (and Part 608, if concurrently jurisdictional). Specifically, the Freshwater Wetland GP will authorize the following: construction or installation of new non-wetland single family residences and related facilities, underground utility cables, conduits or overhead utility cables, single culverts, residential driveways, existing structure expansion, structures in existing impacted areas and the maintenance, repair, replacement, or minor modification of existing structures.

Project Title: Verizon Cellular Tower

Location: Spring Street in the Village of Port Henry, Town of Moriah, New York.

Project Description: The project as proposed is a subdivision into sites, involving the lease of an 80 foot by 80 foot parcel to Verizon Wireless for the construction of a new 115 foot tall telecommunications tower and a 12 foot by 30 foot equipment shelter on a concrete pad at the base of the tower. The tower and equipment building will be located within a 3,025 square foot fenced compound. Verizon Wireless proposes a 12 panel antenna array (i.e. four 8 foot panels on each of three sides of the array) mounted at a centerline height of 106 feet above ground level. To reduce visual impacts the tower is proposed to be a simulated tree tower with branching extending to 121 ± feet above ground level.
