Project Description:

The proposed action is the mining of sand, gravel and clay on a 31.28 acre parcel owned by D&H Materials, Inc. Excavation activities will take place on 29.74 acres. The reclamation plan is to create 15.23 acres of agricultural land within the mine floor area and 14.51 acres will consist of slopes with inverted benches. The remaining 1.54 acres will be undisturbed. The project location is on the south side of Jones Road and east of NYS Route 98 in the Town of Freedom, Cattaraugus County.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant operates a municipal solid waste and construction and demolition debris transfer station at 3675 Jeffery Blvd in the Village of Blasdell. The Department has made a tentative determination to approve a modification for the addition of an 11,000 square foot building that will be used for the management of recyclable materials. The following activities will be performed: tipping, sorting and storage of recyclable material (paper, plastic, wood, metal, cardboard, and fill) prior to transfer for reuse in other markets and baling of cardboard, paper and plastic. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought.

The Department has prepared a draft permit and made a tentative determination to issue a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. The applicant operates a mobile home park at 999 Balmer Road in the Town of Porter and discharges up to 18,000 gallons per day of treated wastewater to Four Mile Creek from a sand filter / septic tank / oxidation pond treatment system. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. The application, draft permit and supporting documents are available for review and comment at the Buffalo Regional Office listed below during regular business hours.
