The New York State Department of Environmental Conservation (NYS DEC) has received a Brownfield Cleanup Program (BCP) application from DCA 1 L. P. for a site known as the DCA 1 Apartments, site ID #C224162. This site is located in the City of New York, within the County of Kings, and is located at 495 Howard Avenue (a.k.a. 485 Howard Avenue), Brooklyn, NY 11233. Comments regarding this application must be submitted no later than August 25, 2012. Negative Declaration

New York County (Manhattan) - The New York City Planning Commission, as lead agency, has determined that the proposed 111 Mercer Street will not have a significant adverse environmental impact. The action involves a proposal by the applicant, Mercer 111, LLC, for a special permit pursuant to Section 74-711 of the New York City Zoning Resolution (ZR) to modify the use regulations of ZR 42-00 for residential use and to modify the bulk regulations of ZR 43-17 for enlargement of a building.

The proposed action would facilitate a proposal by the applicant to have the four floors above the ground floor occupied for residential use and to add a sixth floor penthouse and a first floor mezzanine to the existing five-story building.

The proposed actions include two components:
1. It requires modification of ZR 42-00, which prohibits residential uses (Use Group 2); and
2. It requires modification of ZR 43-17, which prohibits building enlargement in M1-5A districts containing JLWQA units.

The proposed project would include 1,686 square feet of ground floor retail and four dwelling units, one on each floor, including a duplex unit. The site is developed with an existing five-story 74 foot 9 inch tall building totaling, 11,364 gross square feet. A building height increase of 8 feet 4 inches is proposed with the addition of the sixth floor. The first floor is currently occupied by a retail store, which will not be affected by the proposed action. The remainder of the ground/ first floor space would be remodeled for use as a residential lobby with an elevator, stairway and landings. The remainder of the building is vacant.

The analysis year for the proposed actions is 2013.

The project is located 111 Mercer Street within the Soho Cast Iron Historic District of Manhattan, Community District 2, New York.

New York County (Manhattan) - The New York City Planning Commission, as lead agency, has determined that the proposed 54 Greene Street will not have a significant adverse environmental impact. The action involves a proposal by the applicant, 54 Greene Street Realty Corp, for a special permit pursuant to 74-711 of the Zoning Resolution to modify use sections of 42-14(D)(1)(b) and 42-14D(2)(b). The proposed action would facilitate the applicant to convert the second and fourth floors to Use Group 17D Joint Living-Work Quarters for Artists (JLWQA) and legalize Use Group 6 retail units on the ground floor and in the cellar.

The proposed actions include two components:
1. It requires modification of ZR §42-14D (1) (b), which prohibits JLWQA in pre-1961 buildings with over 5,000 square feet of lot coverage;
2. It requires modification of ZR § 42-14D (2) (b), which prohibits Use Group 6 uses below the second floor in M1-5B districts.

Specifically, the proposed special permit would allow approximately 8,239 square feet on floors two and four to be converted into four JLWQA units (Use Group 17D) for a total of 9 JLWQA's within the existing six story building. The proposed action would also legalize approximately 4,418 square feet of commercial retail space (Use Group 6) on a portion of the first and mezzanine floors, as well as 3,821 square feet of retail space on the cellar level. The project site is developed with a 6 story, 33,404 square foot mixed-use building located within in an M1-5B light manufacturing zoning district. In M1-5B zoning district, JLWQA's are not permitted as-of-right in buildings with more than 5,000 square feet of lot coverage. Uses in M1 districts do not permit commercial square footage to exceed 10,000 square feet per establishment. Commercial retail uses (Use Group 6) are also not permitted as-of-right below the second floor of a building within an M1-5B district. The mezzanine level, first floor and two cellar units are currently occupied by non-conforming Use Group 6 (retail). The third unit on the cellar level is an existing legally non-conforming use pursuant to a Certificate of Occupancy. The second and fourth floors contain office and wholesale uses. The existing JLWQA's on floors three, five and six of the building were permitted pursuant to a ZR §74-782 Special Permit for residential loft occupancy issued by the New York City Planning Commission in connection with Application No. C88024ZSM.

The analysis year for the proposed actions is 2013.

Notice of Acceptance of Draft SEIS and Public Hearing

New York County (Manhattan) - The New York City Planning Commission, as lead agency, has accepted a Draft Supplemental Environmental Impact Statement on the proposed 625 West 57th Street. A public hearing on the Draft SEIS will be held at a later date to be announced, in conjunction with the New York City Planning Commission's citywide public hearing pursuant to ULURP. Advance notice will be given of the time and place of the hearing. Written comments on the Draft SEIS are requested and would be received and considered by the Lead Agency until the 10th calendar day following the close of the public hearing. The action involves a proposal by the applicant Durst Development LLC, for a zoning map amendment from M1-5 to C6-2 as well as modifications to existing special permits and a restrictive declaration as well as,other related land use actions (the "proposed action") in connection with the proposed redevelopment of several properties within the Clinton neighborhood in Manhattan, Community District 4. The proposed action includes:

(1) A zoning map amendment to:

  • Rezone of a portion of the project block from M1-5 to C6-2;

(2) Special permits pursuant to:

  • Section 74-743 of the New York City Zoning Resolution to allow, in a large-scale development, (1) floor area to be distributed across the entire zoning lot, (2) buildings to be located without regard for distance between building regulations, and (3) to permit the location of buildings without regard to height and setback regulations;
  • Section 13-561 of the New York City Zoning Resolution for a 285 space accessory parking garage;

(3) Modifications of:

  • The Large Scale General Development site plan associated with the existing special permits (Amendment to ULURP No. C010151 ZSM); and
  • The existing Restrictive Declaration (Amendment to Restrictive Declaration No. D-145 associated with Universal Land Use Review Process (ULURP) No. C010148 ZMM).

The proposed action would facilitate a proposal by the applicant to develop approximately 965,000 zoning square feet (approximately 1.1 million gross square feet) of residential, commercial, community facility, and parking uses) on the affected area. If approved, it is anticipated that the proposed development would be complete and operational by 2015.

The entire block was the subject of a previous Environmental Impact Statement and Land Use Approval in 2001 (West 57th Street Rezoning Final Environmental Impact Statement 2001 FEIS), City Environmental Quality Review (CEQR) No. 00DCP041M and ULURP Nos. 000148ZMM, 010149ZSM, 010150ZSM, 010151ZSM, and 010152ZSM).

The project is located within a portion of the block bounded by West 57th Street to the south, West 58th Street to the north, Eleventh Avenue to the east and Twelfth Avenue to the west in Manhattan, Community District 4, New York.
