Project Description:

The applicant proposes remediation of the existing sewer discharge line which crosses an island within the Moodna Creek (NYS WIN H-89, Class C) and terminates in the Creek near the railroad tracks. Portions of line including the terminus are within NYS-regulated wetland CO-10, Class 1. The proposal includes temporary disturbance of approximately 1700 square feet (sq ft) of the Creek for an equipment access road, temporary impact to 8000 sq ft of wetland adjacent area and 700 sq ft of wetland for construction of a road on the island to access four of the five manholes for clearing of the line between the manholes as well as manhole repair, and dredging an approximately 1200 sq ft area of the Creek and wetland around the existing outlet. If the clearing of the line between the four manholes and dredging of the terminus do not succeed in reestablishing flow through the entire pipe, then a temporary discharge pipe will be installed near the third manhole from the western end of the island which will run into the tidal portion of Moodna Creek within wetland CO-10. The access crossings and road will be removed immediately following completion of the work and the area restored.

Project Description:

The Department has made a tentative determination to approve this application to modify SPDES permit # NY- 015 0100 for Charles River Laboratory to discharge up to 50,000 gallons of treated wastewater per day to an unnamed tributary of Esopus Creek, NYS Waters Index # H-171-30-1, Class C. Permit NY-015 0100 currently authorizes subsurface discharges of 16,000 gpd. The applicant is also proposing construction of new constructed wetland treatment system. A draft SPDES permit, with DEC-proposed effluent limits and monitoring requirements, and a SPDES Fact Sheet are available for review at the DEC Region 3 headquarters in New Paltz. The permittee will be required to maintain records and report data to verify compliance with the SPDES permit conditions and discharge limits. The increase in discharge is related to changes in the facility operations; no new structures are proposed except for the treatment system.

Project Description:

The Department has prepared a Draft Title V Permit renewal for BASF Corporation pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments. BASF, located in the City of Peekskill, Westchester County, New York, on approximately 15 acres of land, operates an existing facility which manufactures pigments. The pigments consist primarily of titanium coated mica, iron oxide coated mica, and bismuth oxychloride mica. In the manufacturing of the titanium coated mica, the process includes particle sizing in reaction slurry vessels, mixing with a titanyl chloride solution and the addition of sodium hydroxide to maintain pH. The slurry is washed and dewatered on a vacuum filter followed by the drying process to cure the coating substrate. The dried product is pneumatically conveyed to tote bins for further packaging and shipment for use in the cosmetic, paint, and plastic markets. The iron oxide coated mica process is similar to the titanium coated process except that ferric chloride solution is added to the mica instead of titanyl chloride. Adding bismuth nitrate to the sodium chloride solution produces the bismuth oxychloride pigments. The facility's main combustion sources are three natural gas boilers (two rated at 12.5 MMBtu/Hr and one at 25.1 MMBtu/Hr), all equipped with low-NOx burners, providing operational building heat and several natural gas furnaces and dryers. Scrubbers and fabric filters are employed for respective gaseous and particulate matter emission control.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the Draft Permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
