Project Description:

Empire Pipeline Inc., a subsidiary of National Fuel Gas, is proposing to perform maintenance on a 400 linear foot section buried 24 inch natural gas pipeline located in the Town of Alabama, Genesee County within the Tonawanda Wildlife Management Area. In order to conduct the maintenance (anode installation, pipe evaluation and re-coating where necessary) an 8 feet deep trench and 50 foot wide work area is required along the 400 foot section of pipeline. The proposed access route to the work area utilizes an existing gravel access road off of Feeder Road, but would also require a new temporary access road to get to the work area.

The project, as proposed, includes approximately 15,060 square feet (0.35 acres) of temporary impacts to wetlands due to temporary crossings, excavation and staging of equipment/materials required to complete the work. Best management practices for erosion and sediment controls as well as wetland crossings will be utilized during construction. All disturbed areas will be restored to original grade and stabilized with seed and mulch.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Aug 02, 2012.
